A by-law to adopt a New Official Plan for the City of Ottawa.
WHEREAS The Planning Act, Section 17 permits the City of Ottawa to adopt an Official Plan;
AND WHEREAS the City of Ottawa has engaged upon public consultation and has held the required statutory hearings for the adoption of an Official Plan;
NOW THEREFORE the Council of the City of Ottawa enacts as follows:
- The document appended to this by-law as Annex "A" entitled "City of Ottawa Official Plan, Volume 1" is hereby adopted as the Official Plan for the City of Ottawa.
- Subject to section 3, all of the Official Plans of the former municipalities and the amendments thereto adopted by the City of Ottawa and in force as of 13 May 2003 are hereby repealed.
- The provisions of the existing Official Plan of the City of Ottawa as of 13 May 2003 as contained within Annexes B (Volume 2-A, Secondary Plans), C(Volume 2-B, Site Specific Policies) and D (Volume 2-C, Village Plans) are not repealed but are modified in accordance with the items contained within the columns entitled "Text language to be updated" and "Changed to".
- (a) All amendments to the existing Official Plan of the City of Ottawa adopted by the Council of the City of Ottawa, or of a former municipality that were not in force as of 13 May 2003 and all policies and schedules to the existing Official Plan of the City of Ottawa that are subject to deferrals are hereby repealed.
(b) All modifications to the existing Official Plan of the City of Ottawa that were not in force as of 13 May 2003 and all amendments or deferrals to the existing Official Plan of the City of Ottawa that come into force on or after 14 May 2003 are hereby repealed. - (a) Subsection 4(a) of this by-law comes into force on the date that the first decision of the Minister of Municipal Affairs and Housing, or his delegate, is issued, pursuant to the Planning Act, section 17, in respect of Annex "A".
(b) Subject to subsection 5(a), this by-law shall come into force in accordance with the provision of the Planning Act. - In this by-law, "former municipality" means the former Corporation of the City of Cumberland, the former Corporation of the City of Gloucester, the former Corporation of the Township of Goulbourn, the former Corporation of the City of Kanata, the former Corporation of the City of Nepean, the former Corporation of the Township of Osgoode, the former Corporation of the City of Ottawa, the former Regional Municipality of Ottawa-Carleton, the former Corporation of the Township of Rideau, the former Corporation of the Village of Rockcliffe Park, the former Corporation of the City of Vanier, and the former Corporation of the Township of West Carleton and "former municipalities"means all of the foregoing.
